What is Agency? 

In real estate, agency refers to the legal relationship between you (the client) and your real estate professional. When you work with a Realtor to buy, sell, or lease property, you’re entering into a formal relationship where the Realtor represents your best interests.

There are four types of agency relationships in Minnesota.

• Seller’s/Buyer’s Agent- Your Realtor advocates exclusively for you, providing fiduciary duties like loyalty, confidentiality, and full disclosure.
• Dual Agency- Your Realtor represents both buyer and seller in the same transaction with the informed consent of both parties.
• Facilitator- The Realtor provides services without formal representation but must remain neutral.

Before any agreements are signed, your Realtor will present the Agency Relationships in Real Estate Transactions Disclosure Form. This ensures you’re fully informed about your options, setting the stage for trust and transparency in the process. How Agents are Compensated in Minnesota
Recent changes in real estate practices have introduced more transparency into how both buyer's and listing agents are paid, allowing greater flexibility and negotiation for all parties involved.

Buyer’s Agent Compensation
In the past, the seller typically covered the cost of the buyer's agent’s commission. However, this is no longer automatically the case. Today, buyers have the opportunity to directly negotiate with their agent on the amount they are willing to pay for their services. This change allows for more flexibility and ensures that the compensation is fully transparent, giving buyers control over what they pay for representation.

Listing Agent Compensation
Similarly, sellers negotiate the commission they will pay their listing agent. While sellers can still opt to offer compensation to the buyer’s agent (also known as the cooperating broker), this is no longer required. If the seller chooses to do so, it will be clearly disclosed, ensuring all parties are informed of the financial details upfront.
